The company Groupe Rossignol Canada Inc. (“Rossignol Canada”) or when referenced together with Skis Rossignol SAS and its affiliates and subsidiaries (hereinafter “Rossignol”, “Groupe Rossignol”, “we”, “us”), offers through its websites and mobile applications various products (the “Products”) and services.

 

Unless we notify you otherwise, Rossignol is the controller and entity responsible for your personal information, and we determine for what purposes and in what manner your personal information will be collected, used, shared, transferred, processed, retained and ultimately destroyed (or anonymized*1).

 

*1 Please note that some personal information cannot be destroyed in a secure and permanent manner. Should this be the case with your personal information, such personal information initially intended for destruction will be permanently anonymized to ensure the protection of your identity.

 

This Privacy Policy has been drafted in accordance with the Personal Information Protection and Electronic Documents Act, which received Royal Assent on April 13, 2000 and as amended by the Act of June 21, 2019, Quebec’s Act respecting the protection of personal information in the private sector as amended by an Act to modernize legislative provisions as regards the protection of personal information, assented on September 22, 2021, Alberta’s Personal Information Protection Act as amended on April 1, 2023, British Colombia’s Privacy Act, as amended on March 30, 2023 and more broadly, in accordance with all legal provisions in force across Canada (hereinafter collectively the "Applicable Law").

  • IDENTIFY the categories of personal information we collect and why;

  • EXPLAIN the manner in which we collect, use, disclose, share, transfer and retain your personal information;

  • DESCRIBE how we protect your personal information;

  • INFORM you of your rights in a user-friendly manner, as well as the recourses you may have vis-à-vis Rossignol Canada in the event of a data breach incident, and/or if you have reason to believe your personal information in our possession is inaccurate or being used inappropriately.

 

This Privacy Policy does not apply to personal information used in the context of:

  • Your employment at Rossignol Canada;

  • When you apply for a job at Rossignol Canada;

as they are covered by distinct privacy policies. With regard to employees of Rossignol Canada, a separate privacy policy is applicable and only made available to Rossignol Canada employees.

 

The Sites are general audience sites and are not designed or intended to target children younger than 14. We do not knowingly target or collect personal information from any person younger than 14 years of age.

1. WHAT PERSONAL INFORMATION IS BEING COLLECTED?

Personal information is any information relating to a person that either directly or indirectly allows them to be identified. Depending on the context and circumstances, this can include sensitive information as well. It could be, for example, your name, e-mail address, telephone number, IP address, however, this list is not exhaustive. Personal information excludes your professional coordinates (e.g. your name, title or position, your professional address, telephone number or fax number). We may collect your personal information either directly from you when you provide it to us (e.g. when you create an account on our Site, if you subscribe to our Newsletters) or indirectly (see our "Cookies" tab). We limit the collection of your personal information to that which is reasonably necessary to fulfill the purposes as outlined in this Privacy Policy.

 

We also collect your de-identified information. De-identified information refers to data that has been either processed, modified or altered in order to remove and/or obscure identifiers that render you identifiable. This information may be disclosed to third-parties and/or permanently anonymized for future use*2.

Depending on the purpose of collection, the personal information collected may include:

  • Any information relating to your identity (e.g. your name, surname, gender, sex, nationality, age);

  • Your contact information (e.g. your personal address, email address, WhatsApp number and personal telephone number);

  • Your educational and professional background (e.g. where you graduated from, copies of your diplomas, past employment);

  • Your physical characteristics such as your personal measurements, weight and height;

  • Any pictures or videos of yourself or your entourage that you post on your social media accounts with the #yesrossignol;

  • Your credit card information, your credit score, or any other information relating to your financial situation for the purposes of collecting any sums owing to Rossignol or when purchasing any one of our products and/or services.

 

We may also automatically collect de-identified information, such as your internet or other network activity (collectively “Network Information”) which includes:

  • Your browsing, navigation and search history, your activity on our Websites, as well as the type and version of your navigation system;

  • Your internet protocol (IP) address, browsing software, and operating system;

  • The internet address of the website from which you linked to our Websites, as well as the time and date of access;

  • Your geolocation and mobile device;

  • Your “opt-out”, cookies and language preferences;

  • Your internet domain and the specific path, actions and navigation choices that directed you to our Websites.

 

When filling out our standardized forms, it is important to fill out all sections deemed mandatory (indicated by an Asterix*). Although you have the right to refuse to disclose your personal information to us, should you refuse please note that we will be unable to process any requests or queries you may have submitted to us.

 

We do not collect personal information relating to your race, ethnic origin, political views, religious and/or philosophical beliefs or health information. However, in the case of personal information relating to your health, we may collect such information in the context of a claim against Rossignol (whether in relation to a Product or alleged accident with a Product and/or Service of Rossignol).

 

2. WHY YOUR PERSONAL INFORMATION IS BEING COLLECTED?

The purposes for which we may collect your information include, inter alia, to:

  • Conclude and document your purchases with Rossignol;

  • Provide our customers with quality Services;

  • Keep our customers informed of all rebates and promotional content of our Products and Services;

  • Promote any and all games, contests or events organized by Rossignol;

  • Keep record of all transactions carried out with Rossignol (either through in-store purchases or online);

  • Host data files that enable our Websites to function, be accessible and to provide specific features or parts of the Websites;

  • Maintain and analyze the functioning of the Websites or Services and to maintain network communications;

  • Personalize your experience on the Websites and to deliver content and Services relevant to your interests and requests through our Websites;

  • Manage the internal accounting affairs of Rossignol;

  • Ensure compliance with local laws and regulations that govern the industry, within all territorial jurisdictions Rossignol operates in;

  • Ensure compliance with the local labour laws of the jurisdictions Rossignol operates in;

  • Manage any and all requests submitted to Rossignol through our Websites, email addresses, or social media platforms;

  • Ensure compliance with all regulations applicable to Rossignol;

  • Address any and all requests relating to the protection of personal information in our possession, including any claims relating to data breaches;

  • Keep track of all communications exchanged with a representative of Rossignol, either through our WhatsApp line*3 , by email or by filling out our contact form found on our “Contact Us” page on our Website;

  • Assure quality control and enforce Rossignol’s standards and policies;

  • Prevent fraudulent activity;

  • Manage security, including monitoring individuals with access to the Websites, applications, systems or facilities, investigate threats and as needed for any data security beach notifications;

  • Monitor and analyze web traffic and online behavior on any and all of Rossignol’s Websites and/or social media platforms for search engine optimization and social media marketing;

  • Mount a case in the event of a lawsuit implicating Rossignol and/or any of its affiliates, directors, administrators, legal representatives, employees, or assigns;

  • Manage the use of Cookies which do not require your express consent;

  • Compile statistical data and analyses to improve our Products, Services and engagement on our Websites and social media platforms.

The above constitutes a non-exhaustive list of purposes for which Rossignol may collect your personal information. Rossignol may also collect your personal information for other secondary purposes which remains consistent with the initial reason for collection. You and Rossignol may also expressly agree to additional purposes for which collection of your personal information may be permitted.

 

3. WHEN AND HOW WE COLLECT YOUR PERSONAL INFORMATION

Rossignol Canada collects the personal information of its customers:

  • Expressly through its interactions in-person at its on-site locations and stores and/or during its games, contests and/or live events;

  • Expressly through its online services, which include Rossignol Canada’s mobile applications, Websites, social media platforms, newsletters and WhatsApp line;

  • Automatically when accessing our Websites and social media platforms.

 

During these interactions, Rossignol Canada may collect your personal information with your express consent or implied consent.

 

3.1 Personal Information we collect with your express consent

When we collect your personal information with your express consent, a dialogue box will pop-up prior to accessing our online services, whereby you will be asked to provide your express consent by clicking on the button “I accept”. When you are purchasing a Product or Service at one of Rossignol Canada’s store locations, a customer service representative will expressly request your personal information at the time of purchase.

 

Whether online or in-person, we collect your information:

  • When interacting with our website and promotional content

    • When you subscribe to our promotional content related to our Products and Services (e.g. our Newsletter);

    • When you apply to any one of our job offers and internship programs posted on our Websites, under the tab “Job Offers”;

    • When you commence a chat session with any one of our product enthusiasts, accessible on our Websites;

    • When you participate in any one of our contests or any contests in which we are a partner. For more information, please consult the terms and conditions of the specific contest which you participated in;

    • When you respond “yes” to our #yesrossignol campaign on our social media accounts, requesting to use any photos and/or videos published on or tagged to our pages and/or accounts;

    • When you create an account on our Website;

    • When you create an account on the Website: onpiste.com and/or download its mobile application “On Piste” on the Apple Store or the Google Play Store;

  • When purchasing one of our many Products and/or Services

    • When you purchase any one of Rossignol’s Products and/or Services;

    • When you make use of any one of our warranties and/or guarantees, for a limited time after purchase;*4

    • When/if you accumulate and/or make use of any one of our loyalty benefits;

    • When we sign any additional contracts with you which may require the use and collection of your personal information;

  • When communicating with us through our Website and/or Social Media Platforms

    • When you contact us directly on our WhatsApp line or open a chat session with one of our product enthusiasts. The personal information collected is usually restricted to your phone number, first and last name, and the subject of your request.

    • When you submit to us your personal information by filling out our standardized form found on our Website, under the tab “Contact Us".

 

Should we ever need to use your personal information for purposes other than those listed in this Privacy Policy, we will inform you as soon as practicable and advise you of your rights and the steps required to exercise your rights vis-à-vis the use of your personal information. Please note that you can always withdraw your consent, regarding our use of your personal information, at any time, by simply emailing our Privacy Officer at: RossignolCanadaPrivacy@rossignol.com.

3.2 Personal Information we collect automatically without your express consent

We may use cookies to recognize you when you return to our Websites in order to provide you with a better user experience. Technologies like cookies, pixel tags, device or other identifiers and local storage are used to deliver, secure, and understand products, services, and ads, on and off social media platforms. They also are used to gather information for remarketing to similar audiences on our Websites. We also allow our affiliates and third-party vendors to use cookies on our Sites; some of these parties may use cookies in ways that we do not and are unaware of. Unless you have updated your browser settings to disable the use of third-party cookies, our system will set both first-party and third-party cookies when you log onto our Websites. In addition to placing cookies on your web browser and local device, we also use:

  • Web Beacons. Pages of the Sites and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Rossignol Canada, for example, to count users who have visited those pages [or opened an email] and for other related website statistics (i.e., recording the popularity of certain website content and verifying system and server integrity).

  • Flash Cookies. Certain features of our Sites use local stored objects (or Flash Cookies) to collect and store information about your preferences and navigation to, from, and on our Sites. Flash cookies are not managed by the same browser settings as are used for browser cookies. We do not use zombie cookies, super cookies or device fingerprinting.

  • Behavioral Tracking. We also may use these technologies to collect information your online activities over time and across third-party websites or other online services. Some web browsers may transmit “do not track” (“DNT”) signals to the Sites with which you communicate. We currently do not change our tracking practices in response to DNT settings in your web browser. Our third-party partners, such as web analytics companies and third-party ad networks, may collect information about you and your online activities over time and across our Sites and Services. These third parties may not change their tracking practices in response to DNT settings in your web browser and do not obligate these parties to honor DNT settings. We utilize Google Analytics for our web analytics and you can opt out of your usage data being included in our Google Analytics reports by visiting Google’s ad settings or by visiting https://tools.google.com/dlpage/gaoptout. Because of this, third-party vendors, including Google and Microsoft, show our ads on sites across the internet. You may also opt out of a third-party vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page.

 

4.RETENTION PERIOD OF PERSONAL INFORMATION IN OUR POSSESSION

At Rossignol Canada, we only retain your personal information for as long as we need to. Once we no longer use your personal information for the purposes outlined under the section titled “WHY YOUR PERSONAL INFORMATION IS BEING COLLECTED” of this Privacy Policy, we proceed with its destruction and/or anonymization.

 

The purpose of collection will determine the duration of the retention period of your personal information. For instance:

  • If you created a customer account on our Website or on the On Piste Website, your personal information will be retained for a maximum period of 5 years following any inactivity*5 on your account;

  • If you subscribed to one of our newsletters, your email address will be deleted from our internal marketing lists 2 years following inactivity (no interaction with us). Should you correspond with our marketing team or request information relating to our marketing materials and promotions at any time, this will restart the 2-year period, until such time 2 consecutive years of inactivity have elapsed once more;

  • If you communicated with us on our WhatsApp line, through our contact forms, or by telephone, such chat threads, forms and recordings will be retained for a period of 3 years and deleted once the subject matter has been resolved, or if local laws require we retain such information for a longer period of time (e.g. should you file a claim or engage in a legal dispute with Rossignol);

  • If you participated in one of our many games or contests, any personal information communicated will be destroyed at the close of the game or contest. Should your prize be delivered after the close of the game or contest in question, your personal information will be destroyed upon delivery of the prize(s) sent by our designated courier;

  • If you purchased any Products or Services of Rossignol, your invoices and other mandatory documents relating to transactions with Rossignol are retained during the fiscal year they were concluded, plus an additional 10 years following the closing date of said transactions;

  • If you filed a complaint or instituted proceedings against Rossignol, any and all correspondence, document or exchange relevant to the dispute and/or complaint will be retained as evidence for 5 years following the claim and/or complaint. This retention period may be extended to 10 years in the event the complaint and/or dispute is the result of an allegation of bodily injury related to the use of one of our Products and/or Services;

  • If you are or have been an employee of Rossignol, personal information related to your employment with us will be retained in accordance with local labour laws of each province across Canada where Rossignol operates;

  • If essential cookies were accepted by you, they will not remain on your browser and/or device for longer than 13 consecutive months;

  • If you signed a contract with Rossignol, or its subsidiaries, whereby a retention period regarding personal information was expressly provided for and agreed upon.

 

*5 Rossignol considers an account inactive when no purchases have been made, no activity has been logged, and the last login into the account or application has exceeded 2 years.

Given all personal information collected by Rossignol Canada is transferred and stored in the databases of our affiliated company Skis Rossignol SAS, located in France, we invite you to consult our France Privacy Policy.

 

4. SHARING AND PROCESSING YOUR PERSONAL INFORMATION WITH THIRD-PARTIES

We only disclose your personal information to authorized members of our staff who require access to it for the purposes of assisting us in providing you quality Products and Services. Any and all personnel who have access to your personal information must participate in trainings in the field of data protection and are required to respect its confidential nature and abide by the local laws that govern data privacy.

 

We only share your personal information with:

  • Our internal departments in charge of customer relations, e-commerce, communication and marketing, legal affairs, finance, and IT;

  • Third party service providers. In the case of third-party service providers, we only share the information necessary to perform the services needed. In addition, we require them to protect your personal information in accordance with the applicable laws and in a manner that is consistent with our privacy policies and security practices. All third-party processing is based on written agreements that comply with requirement as prescribed by law;

Salesforce Commerce Cloud (B2C Website) Name, Address, Phone number, Email, Birthday This includes your website account data (if any), purchases data, opt-in data (if any) which are hosted within this software.
Salesforce Commerce Cloud (CRM) Name, Address, Phone number, Email, Birthday This is an e-commerce platform that runs the digital storefront of Rossignol and streamlines sales and other transactions online.
M3 (Infor) Name, Address, Phone number, Client order number This is the cash register tool used in our retail stores.
Cegid Y2 Name, Address, Phone number, Email, Birthday The transactional information is automatically exchanged between M3 and Salesforce and stored on our internal servers. M3 is also linked with our supply chain software HighJump to complete the shipping process.
Adyen Name, Address, Phone number, Email, Credit card information This provides Rossignol with payment processing services and reconciliation support, in addition to providing us payment terminals that facilitate the purchase and sale of Rossignol products and services. Ayden software is used to authenticate and receive payment.
HighJump Name, Address, Customer account number This is the tool used by Rossignol to manage warehouse logistics. Through its software, HighJump provides inventory management, demand management, transportation management and overall supply chain analytics.HighJump keeps a record of all orders shipped and to be shipped through the creation of a shipping backlog. Orders are identified by customer number and name. HighJump links to M3 in order to obtain your personal information to complete the shipment of your purchase.
Couriers Name, Address, Phone number, Email This is used to carry out the delivery services included in our Services.
Odity Group and META Group Name, IP Address, Email address, Phone number This is used to assist Rossignol with customer service relations online, we outsourced the management of first-level communications with clients made on our WhatsApp line and standardized Website form to the Odity Group. When communicating on our behalf, Odity representatives respond to your queries in accordance with our instructions. We are not responsible for any data breaches or security protocols in place at Odity*6. WhatsApp*7 is owned by its parent company the META Group. According to WhatsApp, all messages and calls exchanged on WhatsApp are end-to-end encrypted and inaccessible by anyone other than the participants to each respective chat initiated. We are not responsible for any data breaches or security protocols in place by WhatsApp and/or the META Group*8.

 

  • Government authorities or regulatory entities requesting your personal information for reasons prescribed by law or in the event we have reasonable grounds to believe your personal information is relevant to an ongoing investigation into unlawful activity or to comply with a subpoena, warrant or any other order made by a Court, the Office of the Privacy Commissioner of Canada, the Commission d’accès à l’information and/or any other entity bestowed with the power to compel the disclosure of personal information;

  • In the context of an imminent or actual lawsuit concerning you and/or your personal information with and/or against Rossignol or any one of its affiliates and/or subsidiaries.

We may also share your personal information with third-parties in the event we intend to:

  • Sell, transfer all or part of our business and/or merge with another business;

  • Secure our assets;

  • When it becomes necessary for the purposes of a financing transaction for a strategic capital operation.

 

We may share aggregated, non-personal information about you with third parties. This is information that is combined with the non-personal information of other users and does not allow you to be identified or contacted. Depending on the circumstances, we may or may not charge third parties for this aggregated information. We also may not limit the third parties' use of the aggregated information.

 

When we share your personal information with third-parties, they are subject to confidentiality agreements and the use of any personal information shared is strictly restricted to the purposes authorized by Rossignol. Moreover, this Privacy Policy is transmitted to them to ensure their respective security measures are compliant with our privacy protocols.

 

Please be advised that Rossignol does not sell your personal information to third-parties. Any personal information shared which falls outside the scope of this Privacy Policy, whether it be for commercial marketing purposes or other, will not be done without your express consent.

 

5. HOW WE PROTECT YOUR PERSONAL INFORMATION

We take all necessary technical and organizational security measures to prevent and minimize the risks associated with the protection of your personal data. These measures include, where appropriate, the use of firewalls, the installation of secure servers, the implementation of appropriate access rights management systems and processes, careful selection of tools and any other measures necessary to ensure appropriate protection of your personal data against unauthorized use or disclosure. In the case of online transactions, we will use standard security measures, such as that available through Secure Sockets Layer (SSL), to protect the privacy and security of online transactions.

 

However, security breaches and errors can occur and we do not guarantee the complete security of personal information. You should be aware that "phishing" is a common practice as well as website hacking or the existence of fake websites, for which we cannot be held responsible.

 

6. TRANSFERRING YOUR PERSONAL INFORMATION OUTSIDE OF CANADA

Rossignol Canada is the Canadian affiliate of Ski Rossignol SAS, a French entity. The personal information you submit to us through our Websites, social media platforms, standardized forms, commercial email addresses and WhatsApp line is collected in the United States and later transferred to France where it is stored in Skis Rossignol SAS’s internal databases. By submitting your personal information to us, you acknowledge and agree that such personal information may be transferred to other jurisdictions, outside Canada*9 , for collection, processing and storage. When your personal information is transferred within Rossignol companies, adequate protection measures are put in place to protect the sensitivity and confidential nature of your information.

 

Prior to transferring your information abroad, Rossignol Canada performs a privacy impact assessment of the information being transferred and puts in place security protocols intended to mitigate any risk factors identified. The level of risk associated with the transfer of your personal information varies from country and service provider. Your personal information is only transferred to third-party service providers (outside Groupe Rossignol) if it is determined that such third-party has put in place adequate protection measures. Despite the diligent steps taken by Groupe Rossignol, it cannot guarantee that your personal information is secure from all risks or data breaches.

Countries where your personal information may be transmitted, stored, or processed may include, but are not limited to:

  • Canada;

  • United States of America;

  • Europen Union member states

 

If you do not consent to the transfer of your personal information outside of Canada, please communicate with our Privacy Officer to better understand the implications of withdrawing your consent to have your information transferred.

 

7. YOUR RIGHTS

Please be advised that you have the right to request any and all Personal Information we possess in your regard:

  • Right to access your personal information in our possession;

  • Right to correct and/or update your personal information;

  • The right to expect us to take reasonable steps to ensure that your information is accurate, complete and up-to-date;

  • Right to request the destruction, deletion, de-identification, anonymization or removal of your personal information *10;

  • Right to the portability of your personal information, free of charge, which implies the delivery of your personal information in a technologically structured and commonly used format (e.g. CSV, XML and JSON etc.). You may request that your information be remitted using a specific format, however, Rossignol Canada has the right to refuse such a request if it raises serious practical difficulties (e.g. significant costs or the transfer is too complex).

 

*10 N.B. We have the right to refuse such a request if it is contrary to the Law and/or our obligations with respect to the protection of personal information.

 

You also have the right to have erased and/or rectified any information we have collected on you, whether that information be incomplete, inaccurate and/or equivocal. Our Privacy Officer will respond to you no later than thirty (30) days following your request for rectification or erasure. Your request for rectification or erasure will be provided to you free of charge. Please note that our Privacy Officer has the right to refuse a request for rectification, if the request is not compliant with the Law. A notice outlining your recourses thereafter will be provided to you at the time the Notice for Refusal to Rectify has been remitted.

 

Opting out of promotional content or advertising emails. Should you wish to opt out of future communications from us, you may do so at any time by clicking on the “unsubscribe” button in the email containing the promotional content you wish to opt-out of, or by contacting us via the email address dpo@rossignol.com or by mailing your request at the mailing address referred to under the section titled “Contact Us” of this Privacy Policy. Please be advised that all opt-out requests made will be dealt with within ten (10) days of receipt of same. Should you continue to receive unsolicited promotional communications from our organization thereafter, please communicate with our Privacy Officer at RossignolCanadaPrivacy@rossignol.com.
