GENERAL TERMS AND CONDITIONS

1. SCOPE OF APPLICATION
These General Term and Condition of sale (hereinafter «Terms») are applicable to orders for products available on our website (hereinafter « Product(s)») accessible via the following link: www.rossignol.com (hereinafter the "Site").
These Terms are applicable between the parties (hereinafter the "Parties") defined below:

SKIS ROSSIGNOL, a company (Société par Actions Simplifiée) incorporated in France and registered at the Trade and Society Register of Grenoble. Our company registration number is 056 502 958 and our head office is at 98 rue Louis Barran, 38430 St Jean de Moirans, FRANCE. Our registered VAT number is FR28056502958 (hereinafter « us » or “we” or “our” or “SKIS ROSSIGNOL”),

The consumer defined as any natural person fulfilling the conditions defined under article 2.1 and placing an order via the Site (hereinafter "you" or “your” or “consumer”).
The Terms apply exclusively to orders delivered in your country in Europe, (the “Country”) to the attention of natural person acquiring Products for non-professional use. Therefore, only natural persons purchasing a Product for purposes that do not fall within the scope of their commercial, industrial, artisanal or liberal activity are therefore targeted here. For sales intended for professionals, we refer to the general terms and conditions of sale reserved for professionals. Only legally capable persons who are not under guardianship and who have a postal address in the Country, may place orders on the Site.
You are informed that we have made the choice to entrust the execution of your order, from its validation to its delivery (including potential return) to our global e-commerce partner, U.S DIRECT E-COMMERCE LIMITED (trading as eShopWorld), a company incorporated in Ireland with registered number 479237 and having its registered office at Fifth Floor, No. 3 Dublin Landings, North Wall Quay, Dublin 1, Ireland (“eShopworld”).
You must accept the General terms and condition of eShopworld when you purchase a Product, as your order is made between you and eShopworld. Applicable law between you and eShopworld is set forth within its general term and condition of sale.
You are informed that French law is applicable to the Terms and in particular to the articles related to liability and warranty which applied between you and us once you purchased a Product on Site. Therefore, all references to article of law or regulation expressed herein shall refer to French legal provision. Nevertheless, if mandatory provision more favorable to the consumer would be applicable in your Country, then such mandatory provision shall apply.
The fact of placing an order through the Site implies your full and unreserved acceptance of these Terms.
We may modify or update these Terms from time to time to comply with law or to meet our changing business requirements without notice to you. You are informed that you and we are bound by the Terms available on our Site at the time you place the order, excepted as expressly provided by mandatory provision applicable from the time of its publication.
The Parties agree that writing in electronic form is admissible in evidence on the same basis as a writing on paper medium. The Parties agree to keep the computer records so that they can constitute faithful and durable copies within the meaning of Article 1379 of the French Civil Code, of any electronic exchange, order, order confirmation or any other document that the Parties may exchange in connection with orders and purchases made on the Site in accordance with these Terms.
2. ORDERS
2.1 Condition
To be able to place an order to purchase Products, you must meet the following cumulative conditions:

complete all the information necessary for payment, place of delivery, choice of payment method and any other information required on the checkout page managed by eShopworld in order to process the orders

hold a valid credit card or an active PayPal account.
2.2 Procedure for placing orders - Validation of orders
After having selected the Product(s) chosen by clicking on the "Add to basket" link, you will be redirected to the payment page managed by our partner, U.S. DIRECT E-COMMERCE LIMITED, trading as “eShopWorld”, a private company limited by shares, incorporated in Ireland with company registered number 479237 and having its registered office at Fifth Floor, No. 3 Dublin Landings, North Wall Quay, Dublin 1, Ireland, which is in charge of checkout, payment and delivery of the Product to you. You will then follow the ordering process which will end with the conclusion of the sales contract between you and eShopworld. During the checkout process, you will be billed by eShopworld for the Product(s), shipping and any duties and taxes applicable in your Country.
Please keep in mind that your transaction will be between you and eShopworld. Your credit/debit card or other payment method will be billed by eShopworld and charges on your statement will be accompanied by the description "eShopWorld", “eSW”, or similar.
2.3 Caution
Please check the accuracy of your order BEFORE finalizing it. Any order definitively validated can no longer be modified or cancelled. Nevertheless, you have a right of withdrawal, which may be exercised under the conditions described under Article 8 below.
You are informed that characteristics of each Product are available online under the description of the said Product. The delivery and billing address, the total price including VAT, the payment method and the delivery times and shipping costs applied, will be displayed before confirming your order.
eShopworld and us reserve the right not to accept an order in the event of non-compliance with these Terms and/or the eShopworld’s general terms and condition of sale, in the event of errors or anomalies in the order (e.g. quantities ordered unsuitable for private or family use), in the event of exorbitantly high discounts or an extremely low price, in the event of a payment incident or suspicion of fraud and/or abuse.
Your order will be confirmed by an email from eShopworld indicating the order number as well as the details of the order to the email address that you have provided. Make sure to keep this confirmation email until the delivery of your order because you may be asked for it.
3. FOR PRODUCTS PURCHASED IN KIT
We draw your attention to the fact that personalized Products:

cannot be returned or refunded AND
-
must be assembled/adjusted in accordance with the rules of the art AND on the basis of the information you have given us. No liability and/or warranty claims can be made for the consequences of an incorrect adjustment based on incorrect information provided by you.
What is a personalized Product?
A personalized Product is a product adapted or modified in an irreversible way and in particular any Product drilled and assembled according to the customer's specifications transmitted at the time of the order. Any Product purchased as a kit (skis and/or snowboard + bindings) is a personalized Product, for which you must provide the necessary data for the assembly and adjustment of the bindings.
The assembly and adjustment of the bindings will be made on the basis of the information you will have given us and confirmed at the time of your order. It is therefore your responsibility to provide us with accurate and correct information. We cannot be held responsible for the consequences of a wrong adjustment of the bindings made on the basis of erroneous information that you would have communicated to us during your order.
It is specified that any personalized Product purchased in Kit cannot be the subject of a return (see article 6 of the present Conditions) and that consequently, you must pay the price of this one in its entirety and that no refunding will be carried out.
In the event that the information you provide does not allow for the adjustment of the bindings according to the standards in force, your bindings will be delivered assembled but not adjusted.
We remind you that the adjustment must be done by a professional.
4. AVAILIBILITY OF PRODUCTS AND SIZE RECOMMANDATION
Our offers of Products and prices are valid as long as they are visible on the Site, except for special operations which validity period is specified on the Site. You are advised to check the availability of the Products sold on the information page of each Product.
In the event you placed an order for a Product temporarily unavailable, we reserve the right to ask eShopworld to cancel your order subject to informing you.
The entire order will only be processed and shipped once all the Products in that order are available.
The conditions of the promotional offers temporarily proposed will be specified on the Site.
To improve your online customer experience, we have installed a tool on our website that allows you to determine the most appropriate Product size based on the data you provide on this tool. This tool is provided by Strutfit, which you can freely choose to use. If you wish to use it, please consult the personal data policy of Strutfit, which processes your data, and/or contact privacy@strut.fit. Please note that we cannot be held responsible for any error in the estimation of the suggested size. In the event that the suggested size is not suitable, you may return the Product to us under the conditions indicated in the “RIGHT OF WITHDRAWAL” section.
5. PRICE - PAYMENT
5.1 Price
Prices displayed on Site are indicated in local currency including Value Added Tax (VAT) but do not include delivery costs.
Products and related services may vary from country to country, depending on some specifics of the country to which the Products are to be shipped.
We reserve the right to modify the prices at any time, but the Products will in any event be invoiced on the basis of the price in force and displayed on the Site at the time the order is placed.
When you access the "order summary" page, the total price of the order appears, including taxes, shipping and handling fees.
If one or more taxes or contributions were to be modified, as well as in the event of new taxes or contributions, this change may be passed on to the selling price of the Products. No tax or contribution not provided for at the time of your order may be requested after the validation of your order.
Delivery costs and fee for the processing of the order may vary depending on the available shipping method you have chosen on the checkout page managed by eShopworld, if applicable.
The amount of the delivery charges will be specified before validating the order. The amount of the shipping costs is added to the total amount of the order of the Products purchased.
5.2 Payment
Payment of the Products is made on the eShopworld’s checkout page, in accordance with eShopworld’s requirements and under their sole responsibility.
The order will only be considered firm and definitive at the end of the online payment procedure, at the time of your receipt of the confirmation email from eShopworld.
Moreover, you agree to be invoiced by eShopworld, in compliance with its general terms and condition of sale. The payment, and security of the payment is managed by eShopworld.
You are informed that no banking information about you transits via the Site.
We do not store your banking information on our servers. Consequently, you must provide them for each new order on the Site.
Despite data encryption, we remind you that no data transmission over the Internet is 100% secure and that information communicated online can potentially be intercepted and used by persons other than the intended recipient.
6. TRANSFER OF RISKS AND TRANSFER OF OWNERSHIP
A Product will be your responsibility from the time that you (or a person nominated by you) take physical possession of the Product.
You own a Product once we have received payment in full (including delivery charges).
7. DELIVERY
The Products are shipped at the address you indicated to us during the ordering process. eShopworld handles the delivery of your Products to you.
eShopworld will provide you with an estimated delivery date on its checkout and order confirmation pages. You can track your Product on the tracking portal provided by eShopworld. You are informed that we do not have no control and no responsability over the transportation, logistic and delivery time of the Product you purchased from eShopworld.
Nonetheless, in case you may have any question about delivery times, logistic, or the follow-up of your order you can contact us at the following address: customer.care@rossignol.com. You must notify the carrier of any reservations about the Product delivered (for example: package or product damaged, already opened, etc.). Reservations must be expressly indicated on the delivery slip.
8. RIGHT OF WITHDRAWAL
8.1 Important information – be careful
The exercise of the right of withdrawal is expressly excluded for any personalized Product. It is reminded that personalized Product means any Product adapted or modified in an irreversible way and in particular any Product drilled and assembled according to the customer's specifications transmitted at the time of placing the order.
8.2 Conditions and contacts
Notwhistanding anything to the contrary in the general terms and condition of sale of eShopworld, you have 30 days after the day you receive the Product(s) to change your mind and end the contract.

Our Customer service will indicate to you to send the Product(s) to the eShopworld’s warehouse, which will then take in charge the shipping of the Products to the ROSSIGNOL’s warehouse. The Customer Service will communicate to you the exact address of the eShopworld’s warehouse, which may be different, depending on your location.
You must take care of the Product(s) while they are in your possession and return them to us in their original packaging (including any accessories and guides) and in the condition that they were provided to you so that they can be resold. If you exercised your right of withdrawal within 30 days of the receipt of the Products, you have a period of 14 days to return the Products to the eShopworld’s warehouse, starting from the day you notify us of your decision to cancel the sales contract. You may have to pay for any return shipping costs, subject to eShopworld conditions.
In case of multiple orders (of several products), the withdrawal period runs from receipt of the last product.
Provided you comply with our return conditions, eShopworld must reimburse you within fourteen (14) days of the return of the Product in a perfect resalable condition. However, the refund may be postponed until the date of the actual receipt of the Product, or at least upon presentation of the proof of the return.
You are informed that we reserve the right to refuse the return of any Product:
-
if you do not comply with the conditions of return under article 8.2;

if, in our reasonable opinion, the Product has been damaged or unreasonably handled by you;
-
if the Product is not in its original packaging (including any accessories and guides) and in the condition that it was provided to you.
A discount on the refund may be applied when the returned Product has obviously been used beyond than a simple trial.
9. WARRANTY
When you purchase one or more Products on our Site or from a store owned and operated by SKIS ROSSIGNOL, the Product is covered by a legal warranty, which may be complemented by a commercial warranty, where this is expressly stated either on the product sheet or on the Site. For the application of any warranty, it is essential to present the proof of purchase. We remind you that if a mandatory legal provision of the Country is more favorable to you than that set out herein, the said more favorable provision shall apply.
The Products are sold, depending on the category you choose:

New and without defects ("1st choice Products");
-
New, with one or more defects of aspect listed and presented only on a dedicated page ("Products with Aesthetic defects")
It is specified that the Products with Aesthetic defects are sold and delivered only in some countries for which there is a page specifically dedicated to the Products with Aesthetic defects/Appearance Defects on the Site. We invite you to check on the Site if a page dedicated to the Products with Aesthetic defects exists in your Country. If not, all the mentions related to the Products with Aesthetic defects are not applicable to you.
WARNING: the guarantees presented on this page are applicable only to consumer customers. This means that only natural persons purchasing a Product for purposes that are not part of their commercial, industrial, artisanal or liberal activity are concerned.
We remind you that some Products require assembly and/or adjustment by a professional.
In general, the information relating to the use of the Products and in particular the safety rules, the conditions of assembly or installation, and the conditions of maintenance of these Products are contained in the instructions for use or user guide delivered with the Product. Failure to comply with the instructions contained therein may result in the invalidation of the warranty.
9.1 LEGAL WARRANTY (APPLICABLE TO 1st CHOICE PRODUCTS)
You benefit from the application of the legal guarantee of conformity of the Products (articles L217-4 and following Consumer Code) as well as the legal guarantee of hidden defects (articles 1641 to 1649 Civil Code).
Legal guarantee of conformity:
We are responsible for providing a Product that conforms to the agreement that binds us. The Product must correspond to the description that we have provided to you, and must have the qualities normally expected of a similar good. We shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at our charge by the agreement or has been carried out under our responsibility.
We shall be liable for any lack of conformity which occurs within a period of two years from the date of purchase. This warranty period applies without prejudice to articles 2224 and following of the Civil Code. The starting point of the prescription of the action of the consumer is the day of the knowledge by the latter of the defect of conformity.
Warranty for hidden defects:
We are also responsible for hidden defects in the Product (redhibitory defects), which are defects that render the Product unfit for the purpose for which it was intended, or that so diminish that purpose that you would not have purchased it, or would have paid a lower price for it, if you had known about them.
This action for latent defect must be exercised within a maximum period of two years from its discovery, and at the latest 5 years after your acquisition of the Product.
In all cases, to exercise this warranty, you must prove that you meet the following cumulative conditions:

The defect must not be apparent at the time of purchase; AND
-
The defect must render the good unfit for its purpose or greatly diminish its use; AND
-
Exist at the time of purchase
9.2 LEGAL WARRANTIES APPLICABLE TO PRODUCTS WITH AESTHETIC DEFECTS (Appearance Defects)
Our customers are expressly informed that the Products with Aesthetic defects may randomly present one or more appearance defects, more or less visible, listed and presented in the page dedicated to "Products with Aesthetic defects" or “Appearance Defects” on the Site (hereinafter collectively the "Appearance Defects").
The customer choosing to purchase a Product with Aesthetic defects acknowledges having been fully informed of the existence of these Appearance Defects prior to the purchase of a Product with Aesthetic defects, and accepts them without reservation. Accordingly, all customers are informed and agree that all Appearance Defects present on the Product with Aesthetic defectst purchased are NOT GUARANTEED. Thus, Products with Aesthetic defects may NOT be refunded, exchanged, or repaired due to the presence of one or more Appearance Defects.
For any defect other than an Appearance Defect, the legal warranties continue to apply under the same conditions as for 1st choice Products. However, if the choice of exchange has been retained, it is expressly stated that a Product with Aesthetic defects can only be replaced by an equivalent Product with Aesthetic defects. In any case, a Product with Aesthetic defects can NOT be exchanged for a 1st choice Product. In case of unavailability of an equivalent Product with Aesthetic defects, and when the repair is materially impossible or involves a manifestly disproportionate cost for us, the customer will be refunded.
9.3 COMMERCIAL WARRANTIES
We may offer our customers, in addition to the legal warranties applicable to all of our Products, a commercial warranty that applies restrictively to some Products. Any extension of warranty or commercial warranty must be expressly and clearly provided for in order to be exercised.
We are under no obligation to grant a commercial warranty on all or part of our Products, if not expressly written.
This extended warranty applies, when it exists, either when the legal warranty cannot or no longer be applied, or when the extended warranty is more favorable to you. The extended warranty does not override or cancel the effects of the legal warranty.
Currently, only our bicycles (presented among our 1st choice products) benefit from a commercial warranty. This is detailed on the page dedicated to bikes.
9.4. EXCLUSION OF WARRANTY
Excluded from the legal and commercial warranties are damages resulting from:
-
Failure to comply with installation, assembly or mounting instructions, any abusive or inappropriate use, accidents, or any other use for which the Product was not designed, in the event of failure to comply with the warnings in the user manuals and, more generally, in the event of failure to comply with the conditions of use of the Products as provided in the user manuals, if any;
-
Normal wear and tear of the Products, including fatigue. It is the customer's responsibility to maintain or have maintained each Product in accordance with the instructions provided in the user manuals, if any;
-
Repair of the Product or removal and/or replacement of component(s) not performed by a specialized professional and/or
-
The use of non-genuine and non-approved spare parts; and/or
-
The addition of accessory(ies) whose compatibility with the Products has not been expressly validated by us and carried out by a specialized professional, and/or
-
The possible consequences of a wrong adjustment of the Products made by a third party and/or made on the basis of erroneous information transmitted by the customer at the time of ordering the Product,
-
Adjustment, setting, assembly and/or maintenance of the Product by a non-professional when the intervention of a specialized professional was required by the user manuals or the Product's instructions. In this respect, we remind you that the assembly and adjustment of certain Products must be carried out either by a specialized retailer with the appropriate technical knowledge and tools, or directly by the manufacturer;

A shock by torsion, compression, fall or abnormal impact of the Product leading to a modification of the Product;
-
Scratches or damage to the decorative elements of the Product due to its use;
-
Alteration of the colors and/or size and/or texture of the Products resulting from normal wear and tear and/or improper maintenance of the Product;
-
Products with a serial number that has been removed or is incomplete,
-
The presence of one or more Appearance Defects in the appearance of a Product with Aesthetic defects
9.5 IMPLEMENTATION OF LEGAL WARRANTIES AND/OR COMMERCIAL WARRANTIES
As part of the legal guarantees you benefit from, we commit ourselves according to your choice to either:
-
Replace your 1st choice Product against another 1st choice Product of the same category and value. If it is a Product of 2nd choice, this one will be able to be replaced only by a Products with Aesthetic defects equivalent choice of the same value. Products are replaced subject to availability;
-
Repair the Product at our expense if this is possible and send it back to you at the address indicated by you.
The repair and, if necessary, the shipment of the replaced or repaired Product will take place at no cost to you.
If we are unable to repair or replace the Product that is the subject of your warranty claim, we will refund the full price of the Product (with the return of the Product in accordance with the terms of our General Terms of Sale).
It is nevertheless brought to your attention that if one of these choices is materially impossible to implement, or involves a manifestly disproportionate cost for us, we reserve the right to choose the most appropriate option, in accordance with Articles L217-12 of the Consumer Code.
9.6 LIMITS
No warranty shall extend beyond the warranties (statutory and commercial) described herein, unless otherwise provided by law in your Country in Europe. All other warranties, express or implied, including but not limited to warranties of merchantability and/or fitness for a particular purpose, are expressly excluded.
Some jurisdictions do not allow the exclusion or limitation of implied warranties or consequential damages, so the above limitations or exclusions may not apply to you.
9.7 LEGAL PROVISION (APPENDIX OF THE ARTICLE D.211-2 OF THE FRENCH CONSUMER CODE)
“The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in case of a defect of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
"Where the agreement for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty shall apply to that digital content or digital service throughout the period of supply provided. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or service and not the date of its appearance.
"The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all the updates necessary to maintain the conformity of the goods.
"The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of his request, without charge and without major inconvenience to him.
"If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
"If the consumer asks for the good to be repaired, but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good.
"The consumer may obtain a reduction in the purchase price by keeping the good or terminate the agreement by obtaining a full refund against return of the good, if:
"1° The trader refuses to repair or replace the goods ;
"2° The repair or replacement of the goods takes place after a period of thirty days;
"3° The repair or replacement of the goods causes a major inconvenience to the consumer, in particular when the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if he bears the cost of installing the repaired or replaced goods;
"4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
"The consumer is also entitled to a reduction in the price of the goods or to rescission of the agreement when the lack of conformity is so serious that it justifies the reduction in price or the rescission of the agreement being immediate. The consumer is then not required to first request repair or replacement of the goods.
"The consumer is not entitled to rescind the sale if the lack of conformity is minor.
"Any period of immobilization of the goods for repair or replacement suspends the warranty that remained until the delivery of the repaired goods.
"The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
"The seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
"The consumer also benefits from the legal guarantee of hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the good is kept or to a full refund against return of the good."

11. REIMBURSEMENT
11.1 Refund in case of withdrawal and/or implementation of the guarantee
The refund of the Product (and the initial delivery costs) will be confirmed by email and will take place within a maximum of fourteen (14) days from the day:

The option of refunding the Product under warranty has been chosen in accordance with the conditions of article 9 hereof (Implementation of the legal and/or commercial warranty)
-
You have decided to exercise your right of withdrawal in accordance with the provisions of article 8 hereof (Exercising your right of withdrawal)
In the event of a partial cancellation of an order, eShopworld will reimburse only the Product(s) that are the subject of the cancellation, subject to the provisions of Article 8 hereof. We remind you that any request for retraction and corresponding reimbursement made more than thirty (30) calendar days after the date of receipt of your order cannot be considered.
Eshopworld will make this refund, and reserves the right to defer the refund until the date of actual receipt of the Product, or provision of a valid proof of shipment. Delivery fees will be refunded in accordance with eShopworld's general terms and conditions.
11.2 Refund in case of late delivery
In case of non-respect of the delivery time, you can cancel your order in application of the article 6 of the present and of the articles L.216-1 to 216-3 of the Consumer Code. You will receive a full refund for your purchase of the Products (and of the initial expenses of delivery) of the aforementioned order within fourteen (14) days after reception of your mail by which you ask for the resolution of the sale, except exceptions envisaged in the articles of the Consumer Code above mentioned. If you receive the Product after having resolved the sale, you must return it at the address indicated by the Customer Service in its original packaging and condition, at the latest within fourteen days (14) days of your receipt of the Product. eShopworld will manage the reimbursement.
eShopworld reserves the right to refund an express delivery at the standard delivery rate.
12. INTELLECTUAL PROPERTY

Therefore, in accordance with the provisions of the Intellectual Property Code, only the viewing of the Site for private use is authorized.

13. LIABILITY
We are responsible to you for foreseeable loss and damage caused by us to you, in case we fail to comply with these Terms and/or if we fail to use reasonable care and skill on the design and manufacture and/or setting-up of the Products, but we are not responsible for any loss or damage that is not foreseeable, or in case you provided us with incorrect information when those information are required. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you purchased a Product, both we and you knew it might happens. In particular, we are not responsible for the suitability of the Products for the purposes for which you intend them, unless you and we expressly agree on it.
WITH RESPECT TO SKI BINDINGS, YOU ARE RESPONSIBLE FOR PROVIDING ACCURATE INFORMATION TO US SO THAT WE CAN MAKE THE PROPER ASSEMBLY AND SETTINGS. WE WILL PERFORM THESE OPERATIONS ON THE BASIS OF THE INFORMATION YOU PROVIDED US WITH DURING THE ORDERING PROCESS AND IN ACCORDANCE WITH ESTABLISHED SKI INDUSTRY STANDARDS. WE CANNOT BE HELD LIABLE FOR ANY DAMAGES RESULTING FROM ASSEMBLY OR ADJUSTMENTS THAT ARE BASED ON INCORRECT INFORMATION PROVIDED BY YOU.
IF THE INFORMATION YOU PROVIDE DOES NOT ALLOW US TO MOUNT OR ADJUST YOUR BINDINGS IN ACCORDANCE WITH ESTABLISHED SKI INDUSTRY STANDARDS, YOUR BINDINGS WILL BE MOUNTED BUT NOT ADJUSTED. IT IS YOUR SOLE RESPONSIBILITY TO HAVE YOUR BINDINGS ADJUSTED, TESTED BY A SKI PROFESSIONAL BEFORE USING THEM.
We are not liable for business losses and/or damages. We only supply the Products for domestic and private use. If you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
The pictures presented on the Site are provided for illustrative purposes only. You are advised to refer to the description of each Product to find out its precise characteristics and, in case of doubt, please contact our Customer Service.
Our Site may contain links to third party sites that we have not published and do not control. These links are provided solely as a convenience to you and should not be construed as an express or implied endorsement of these sites, their content, or any products or services offered on them. While we make reasonable efforts to ensure that our Site functions properly, we do not warrant that the Site will be uninterrupted, slow or error-free, or that defects will be corrected, or that the Site is free of viruses or bugs. 14. DATA PROTECION
On the basis of the execution of the sales agreement during your purchases on our Site and our legitimate interest to implement our activities, we inform you that we collect and process your personal data for the needs of the management of your order and more generally for the needs of the management of the customer relationship: creation of account (when you decide to create such an account), order taking, payment, management and follow-up of the right of withdrawal, request for exchange or return, request for SAV. These personal data are: name, first name, address, telephone number, e-mail address. For the exclusive purposes of processing your order through eShopworld pages, these data are shared with this latter. Your data are kept, after a sale, for a period of five years for evidentiary purposes and to implement the legal and/or commercial guarantees, if necessary. Invoices and other mandatory documents relating to commercial transactions are kept for the duration of the current financial year, plus 10 years from the closing date (accounting and tax obligations).
If you have created a customer account, your customer account and the data entered in it will be kept as long as your customer account is active on the Site. Your account and the data stored in it will be deleted after 5 years of inactivity, or sooner if you expressly request otherwise. You may request the deletion of your account or certain of your data at any time in accordance with the procedure described herein. You may also change your account information directly on the Site. 16. APPLICABLE LAW AND LEGAL PROCEEDINGS
These Terms are governed by French law and you can bring legal proceedings in respect of the Product(s) to the competent courts of your Country. Nonetheless, in case a mandatory legal provision that is more protective of consumers exists in the Country, then this provision will apply instead of the less advantageous French Legal Provision.
In the event that one of the clauses of the Conditions is declared null and/or void, the other clauses will nevertheless remain in full force and effect.
17. MEDIATION
In accordance with the provisions of the Consumer Code concerning "the process of mediation of consumer disputes”, after having contacted us and in the absence of a satisfactory answer, you have the right to use a free consumer mediation procedure with:
