The company SKIS ROSSIGNOL SAS offers through its websites various products (the “Products”) and services. As such, the company SKIS ROSSIGNOL (hereinafter “ROSSIGNOL”, “GROUP ROSSIGNOL”, “we”, “us”), undertakes, in its capacity as controller, to respect the confidentiality of your personal data in accordance with the Data Protection Act dated January 6, 1978 as amended by the Act of June 21, 2018, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 ("GDPR"), and more broadly with all legal provisions in force (hereinafter collectively the "Applicable Law").
These conditions (the "Conditions") explain:

How ROSSIGNOL, as controller, collects and uses your personal data in its stores and/or through its online services. Our online services include our mobile applications (referenced on this website), websites published by ROSSIGNOL, including this site, social media platforms and any other online services (collectively the "Site"). Your personal data are collected in particular when you create an account, make an online purchase on our Site or in case of interaction with us, when you register to receive newsletters from us or from our subsidiaries or when you participate in games or events organized by ROSSIGNOL, (collectively the "Services").

Note: The Sites are general audience sites and are not designed or intended to target children younger than 16. We do not knowingly target or collect personal information from any person younger than 16.
1. COLLECTION AND PURPOSES OF PROCESSING OF PERSONAL DATA
A Personal data is any data that can identify you directly or indirectly. It could be, for example, your name, e-mail address, telephone number, IP address, etc., this list not being restrictive. We may collect this information directly from you when you provide it to us (for exemple, when you create an account on our Site, if you subscribe to our Newsletters) or indirectly (see our "Cookies" tab).
1.1 On the basis of your consent, we implement processing for the following purposes:
We may collect and process personal data based on your express consent when:

You subscribe to our Newsletters. We periodically send you communications about promotions, offers related to our products and Services; and/or

You apply directly to one of our job and/or internship offers, and/or

You have accepted the installation of cookies on your electronic devices, when these cookies are not strictly necessary for the proper functioning of the Site (see our "Cookies" policy to know more about their specific use and finalities); and/or

You have participated in one of our contests, organized by Rossignol and/or one of its subsidiaries and/or partners identified in the contest rules. You will find all the information relating to the processing of your data for each contest in the contest rules; and/or

You have agreed to our use of your photographs and/or video published on social networks in public mode after having responded to our #yesrossignol solicitation (see our Terms of Use #yesrossignol); and/or

You create an account/install and use one or more of our mobile applications (listed on the Website);

We conduct marketing operation, research and analysis based on your express consent.
1.2 In order to form and perform a contract, we carry out processing for the following purposes:

You purchase products or services online or in our stores. The processing of your personal data is therefore essential to provide you with the products and/or services for which you have requested us,

The implementation of guarantees, and the provision of after-sales service;

The implementation of the collection and use of your possible loyalty benefits to follow up your purchases, if any;

To manage and implement any contractual agreement between us and you which requires the provision of personal data of the signatories or participants in the formalization of such contractual agreement and/or for its implementation.
1.3 Based on our legal and regulatory obligations, we implement processing for the following purposes:

Keeping of mandatory documents relating to the transactions carried out (purchases in store and/or on the Site);

To comply with our legal obligations, in particular, but not limited to, with regard to labor law in the event that you are hired;

To comply with our legal obligations, including, but not limited to, employment law, should you be hired;

1.4 Based on our legitimate interests, we implement processing for the following purposes:

The management of your complaints, including claims relating to accidents involving Products;

You decide to contact us, either by our contact form, by telephone, by our WhatsApp line, by email to ask us about our Products, services, current orders. We keep our exchanges for proof purposes, in particular to demonstrate the provision of pre-contractual information/information related to the safety/condition of use of our Products. In this connection, we inform you that any complaint or dispute that may contain sensitive data will not be processed via WhatsApp. We invite you to contact us via our contact form;

The prevention and fight against fraud;

Monitor and analyze web traffic;

The establishment of any means of proof necessary for the defense of our rights;

The management of cookies not subject to consent;

The realization of statistics and analyses in order to improve our Services and products, our Sites.
If we need to process your personal data for purposes other than those listed in this tab, we will inform you at the time of implementation of the processing concerned and will proceed with the necessary steps.
2. COLLECTED DATA
Depending on the purposes (see section I COLLECTION AND PURPOSES OF PERSONAL DATA PROCESSING), the personal data collected may include:

Your identity (including name, surname, gender, nationality, age, image);

Your contact information (including your postal address, email address, telephone number);

Your diplomas, professional background or any other information necessary and/or required by law in view of your possible employment, if you have applied for one of our job offers;

Your preferences (including your measurements in relation to purchases made in order to make necessary adjustments, if any);

When you contact us via WhatsApp or by phone, we collect your phone number, first and last name, and the subject of your request;

Other information that you provide to us by filling out forms or by contacting us (by phone, e-mail, or other means). In this case, we will inform you of the use and nature of the processing on a case-by-case basis.
Failure to provide certain requested information may delay or make impossible the processing of your request, the answer to your questions and/or the provision of products and/or services, and/or the formalization of a contract between you and us. In this respect, some data are mandatory (indicated by an * in the forms), and you are informed that in their absence, we will not be able to process your request.
We recommend that you only provide the data requested or necessary for your request, with the express exception of sensitive data not processed by Rossignol such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, and health data (with the exception, in the case of health data, the data you provide to us in the event of a claim relating to a Product in connection with an accident) or data concerning sexual life or sexual orientation.
3. DURATION OF PERSONAL DATA PROCESSING
In order to determine the length of time we keep your personal data, we have taken into account the reasons (purposes) for which we collect this data, the legal basis for the processing (see our article 1 COLLECTION AND PURPOSES OF PERSONAL DATA PROCESSING BY ROSSIGNOL), where applicable, the compulsory legal duration of certain processing operations, as well as the recommendations of the CNIL, the French administrative body in charge of the protection of the personal data.
More generally, your personal data will be processed for the time necessary to achieve the purpose of the corresponding processing.
Thus,

If you have a customer account, your personal data will be kept for a maximum of 5 years from the time your account is inactive;
-
If you have subscribed to one of our newsletters, your email address will be deleted after 3 years of inactivity (no interaction with us). Exchanging emails, requests for information will start the 3 year period again;

When you exchange with us, notably via WhatsApp, or through our contact forms, or by telephone (with prior consent to record our conversations) our conversations will be kept for 3 years and deleted once the subject of our exchanges has been closed, or at a later date if the request concerns one of the cases below which would require a longer retention period (for instance a claim or a dispute);

If you have participated in a contest, the data communicated will be will be deleted at the end of the game contest, or at the latest upon delivery of the prizes if we have to send you a parcel by post;

Invoices and other mandatory documents relating to transactions are kept for the duration of the current fiscal year, plus 10 years from the closing date;

Your requests to exercise your rights, disputes and complaints: the exchanges are kept for five (5) years as evidence. This period may be extended to 10 years in the event of bodily injury related to our Products;

If you have been hired, your data related to your employment will be kept according the legal duration as provided under the labor law applicable;

The deposit of accepted or essential cookies cannot exceed 13 consecutive months;

The duration indicated in any contract between you and ROSSIGNOL or one of its subsidiaries.
However, we remind you that when the processing is based solely on your consent, you may at any time ask us to delete your personal data (see the article "Your rights").
4. RECIPIENTS OF PERSONAL DATA
We disclose your personal data only to those persons who need access to it and who are authorized to process it for the purposes mentioned above and who undertake to respect its confidentiality.
Thus, we may communicate your personal information:

Internally to the departments in charge of customer relations, e-commerce, communication and marketing, legal affairs, finance, our IT services;

To third parties acting on our behalf and on the basis of our instructions set forth in a binding contract that complies with the requirements of applicable law. The communication of some of your data is necessary in order to:

Ensure the delivery service for your online purchases/ensure the delivery of your possible winnings during the contests;

Authenticate/receive payments and process orders where applicable;

Hosting your data in the context of our mobile applications/online services by specialized providers;

Hosting and conducting marketing research, subject to obtaining your prior consent;

To carry out the contract signed between you, us and a possible partner if necessary;

Process your claims (products, shipping, any claims related to orders…);

Process your claims in case of accident in connection of our Products (external advice);

In the particular case of our WhatsApp messaging and first-level exchanges on our form, your data are processed on our behalf by the company TFour SRL (known as “Odity”), which must respond to you according to our instructions. Data communicated on WhatsApp is also accessible to WhatsApp, owned by the META group (Facebook). Exchanges on WhatsApp are subject to the latter's conditions.

These recipientsare subject to a confidentiality obligation and are not authorized to use your data for purposes other than those authorized. We also require them to apply appropriate security measures to protect your personal data, and we ask them to process your personal data in compliance with the minimum requirements of this Privacy Policy.
We may be required by mandatory provisions of applicable law or in connection with legal proceedings or other legal requests, to disclose your personal data to authorities or third parties.
We may also disclose or process your personal data in accordance with applicable law to defend our legitimate interests (for example in civil or criminal proceedings). For instance, we may disclose your personal data if necessary to identify, contact or bring legal action against a person or entity that is violating our Terms and Conditions of Sale or Use or is causing distress or harm to other users of our Site.
In any case, we undertake not to sell your personal data. ROSSIGNOL undertakes not to share or communicate in any way your personal data to third parties for commercial/marketing purposes without your prior and express consent.
5. SECURITY
We take all necessary technical and organizational security measures to prevent and minimize the risks associated with the provision of your personal data. These measures include, where appropriate, the use of firewalls, the installation of secure servers, the implementation of appropriate access rights management systems and processes, careful selection of tools and any other measures necessary to ensure appropriate protection of your personal data against unauthorized use or disclosure. In the case of online transactions, we will use standard security measures, such as that available through Secure Sockets Layer (SSL), to protect the privacy and security of online transactions.
However, security breaches and errors can occur and we do not guarantee the complete security of personal information. You should be aware that "phishing" is a common practice as well as website hacking or the existence of fake websites, for which we cannot be held responsible.
6. TRANSFER OF DATA OUTSIDE THE EU
Our products and Services may be provided using resources and servers located around the world. Thus, your data may be transferred outside the European Union. In this case, we ensure that such transfer complies with the applicable legal framework, that a sufficient level of protection of your personal data is guaranteed in accordance with the applicable law, for example by using standard agreements approved by the competent authorities (if necessary) and by requesting that other appropriate technical and organizational information security measures are implemented.
7. YOUR RIGHTS
In accordance with the applicable Law, you have a right of access, rectification, deletion, limitation of processing, opposition to the processing as well as a right to object to the use of your data for commercial prospecting, portability with regard to personal data concerning you, within the limits and conditions provided for by the applicable Law. These rights can be exercised free of charge. Finally, you have the right to define general and specific directives defining the manner in which you intend these rights to be exercised, after your death, under the conditions defined by decree. We also inform you that the exercise of the above-mentioned rights may be limited or conditioned depending on the legal basis of the processing. Nevertheless, when the processing is carried out on the legal basis of your consent, you may unconditionally and at any time exercise all of the above-mentioned rights.
8. IMPLEMENTATION AND MANAGEMENT OF COOKIES
We may collect personal data when you browse our Site and/or our mobile applications, such data may include your IP address or other browsing data through cookies. Cookies are small data files that store information related to a website. Some cookies are necessary for the proper functioning of the Site and mobile applications, others (provided you gave your express consent) are used for analytical purposes that help us personalize and improve our services. 9. THIRD PARTY COOKIES AND SOCIAL NETWORKS
Some of ROSSIGNOL's partner companies may issue cookies from certain areas accessible on the Site. The issuance and use of these cookies are subject to the privacy policies of these companies.
In addition, we may include on the Site computer applications from third parties, which allow you to share the contents of the Site with other people or to let these other people know your consultation or your opinion concerning a content of the Site. This is notably the case of the "Share" and "Like" buttons from social networks such as Facebook, Twitter, etc.
We invite you to consult the privacy protection policies of these social networks in order to learn about the purposes of use, including advertising, of the browsing information that they may collect through the sharing features of these social networks. These protection policies should allow you to exercise your choices with these social networks, in particular by setting up your accounts for each of these networks.
10. USE OF GEOLOCATION DATA
When you access the Site via a mobile device, you may be asked to determine your location only if you consent so that we can provide you with the most accurate information possible (e.g. Store Locator). We do not share this location with third parties. If you do not want to share this information, you can disable the use of location services at any time in the application settings.
11. CHANGES TO TERMS AND CONDITIONS
These Terms supersede any information previously provided about our personal data practices. They are not intended to replace any other agreement or terms you may have with us under any particular agreement. We reserve the right to change these Terms at any time.
12. DATA COLLECTED BY STRUTFIT
If you use the tool to help you determine your shoe size available on our website, we inform you that you are communicating your data directly to STRUTFIT via their dematerialized tool. STRUTFIT is therefore responsible for processing this data:
- Transimtted image;
- Gender;
- Surname/first name;
- IP address;
- Your country (identified by your IP address);
- Your email address
